These Terms & Conditions govern any project, proposal, invoice or engagement between DesignPlek ("DesignPlek", "we", "us") and the client ("you"). By approving a proposal, paying a deposit, or otherwise engaging our services, you agree to be bound by these terms.
DesignPlek provides branding, UI/UX design, web development, 3D design, digital marketing design and packaging design services. The specific scope, deliverables and timeline for each project are defined in a written proposal or statement of work agreed with the client before work begins.
Projects proceed through discovery, concept development, design and refinement, and final delivery. Timelines quoted in a proposal are estimates based on the agreed scope and depend on timely client feedback. Delays in providing feedback, content or approvals may extend the delivery date accordingly.
Each package includes a defined number of revision rounds, outlined in the proposal. Additional revision rounds or scope changes beyond what was agreed may be billed separately at our standard rate.
Upon receipt of full payment, ownership of the final approved deliverables transfers to the client. DesignPlek retains the right to display completed work in its portfolio, case studies and marketing materials unless otherwise agreed in writing. Any third-party assets (stock imagery, fonts, plugins) used in a project remain subject to their own licensing terms.
You agree to provide timely feedback, necessary brand assets, and any content required to complete the project, and to ensure any materials you provide to us do not infringe on third-party rights.
DesignPlek's total liability for any claim arising from a project is limited to the amount paid by the client for that project. We are not liable for indirect, incidental or consequential damages.
Either party may terminate a project with written notice. In the event of termination, the client is responsible for payment for all work completed up to the termination date.
These terms are governed by the laws of France, without regard to conflict of law principles. Any dispute arising from these terms or a project engagement is subject to the exclusive jurisdiction of the courts of Toulouse, France.
